1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the PoolPal website, mobile applications, and related services (collectively, the "Platform"), operated by Poolpal Private Limited. By creating an account, booking a ride, offering a ride, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Platform. Drivers must additionally hold a valid driving licence, vehicle registration, and insurance as required by applicable law.

3. Nature of Our Service

PoolPal is a technology platform that connects riders with drivers and service providers. We facilitate carpooling, ridesharing, taxi bookings, goods transport, and related bookings. PoolPal is not a transport operator and does not own or operate the vehicles listed on the Platform. Any journey undertaken is a contract between the rider and the driver.

4. Accounts and Registration

• You agree to provide accurate, current, and complete information during registration and to keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials and OTPs.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.

5. Bookings, Fares and Payments

• Fares are calculated based on distance, duration, vehicle type, applicable taxes, and any surge or promotional pricing in effect at the time of booking.
• The fare shown before confirmation is an estimate; the final amount may vary due to route changes, waiting time, or tolls and parking charges.
• Payments may be made through the payment methods supported on the Platform. You agree to pay all charges incurred on your account.
• PoolPal may charge a platform or convenience fee, which will be disclosed before you confirm a booking.

6. Cancellations and Refunds

Cancellations made after a driver has been assigned may attract a cancellation fee. Refunds, where applicable, are processed to the original payment method and may take up to 7 working days to reflect, depending on your bank or payment provider.

7. User Conduct

While using the Platform, you agree not to:

• Use the Platform for any unlawful, fraudulent, or harmful purpose.
• Carry or transport prohibited, illegal, or hazardous goods.
• Harass, threaten, discriminate against, or endanger any other user, driver, or third party.
• Damage a vehicle or the property of another user.
• Attempt to interfere with, reverse engineer, or gain unauthorised access to the Platform or its systems.
• Create fake accounts, manipulate ratings, or misuse promotional offers.

8. Safety

We take reasonable steps to verify driver documents and profiles, but we cannot guarantee the conduct of any user. You are responsible for exercising your own judgement and taking usual safety precautions when travelling. Please report any safety concern to us immediately through the in-app support option or the contact details below.

9. Intellectual Property

All content on the Platform — including the PoolPal name, logo, designs, text, graphics, and software — is the property of Poolpal Private Limited or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Poolpal Private Limited shall not be liable for any indirect, incidental, special, or consequential loss arising out of or in connection with your use of the Platform, including loss arising from the acts or omissions of any driver, rider, or third-party service provider. Our aggregate liability for any claim shall not exceed the amount paid by you for the specific booking giving rise to the claim.

11. Suspension and Termination

We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or created a risk to other users or to PoolPal.

12. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. The courts at Hyderabad, Telangana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
